When you book a trip with us, the following conditions apply:

ITEM 1. DEFINITIONS

The following definitions are used in these general terms and conditions:

1. GERMANS TRAVEL: Germans Travel PTY LTD, with its registered office in St Kilda, Australia, at 12 Robe Street, St Kilda, 3182, Victoria, Australia, registered with the Australian Securities & Investments Commission (ASIC) under Australian Business number 32 642 335 153, being the travel organiser.

2. GERMANS TRAVEL is registered in Australia and is therefore governed by Australian law and regulations.

3. Travel agreement: the agreement between the main booker and GERMANS TRAVEL whereby GERMANS TRAVEL undertakes towards the main booker to provide a pre-organized trip offered by them and whereby the main booker undertakes to pay the travel sum on behalf of all travelers, under the conditions as stated in these general terms and conditions.

4. Travel: what is specified in the travel agreement.

5. Traveler: any person or company for whom GERMANS TRAVEL puts together a trip.

6. Main booker: the person or company who requests a trip on behalf of themselves and/or for the benefit of one or more travelers from GERMANS TRAVEL (can also be a traveller) and the contracting party of GERMANS TRAVEL.

7. GERMANS TRAVEL website: www.germans.travel

8. Working days: Monday to Friday, excluding recognised holidays.

ITEM 2. CONCLUSION OF TRAVEL AGREEMENT

1. The travel agreement is concluded by approval of the main booker (on behalf of themselves and/or for the benefit of one or more travelers) of the offer of GERMANS TRAVEL. After the travel agreement has been concluded, the main booker will receive confirmation in the form of one or more travel vouchers.

2. Every offer from GERMANS TRAVEL is without obligation and can be revoked by GERMANS TRAVEL at the latest the next working day after approval, stating reasons. Revocation due to errors in the travel sum calculation is permitted.

3. The lead booker will provide GERMANS TRAVEL with all information about themself and the travelers registered by them at the latest when entering into the travel agreement that may be important for the proper execution of the travel agreement by GERMANS TRAVEL.

4. The main booker is jointly and severally liable for all obligations of the traveler(s) arising from the travel agreement. All communication and payment transactions between the traveler(s) and GERMANS TRAVEL takes place exclusively via the main booker. If the travel agreement is entered into by several main bookers, they are all jointly and severally liable for all obligations of the traveler(s) arising from the travel agreement.

5. Obvious errors and mistakes in the offer do not bind GERMANS TRAVEL.

6. GERMANS TRAVEL is not responsible and liable for general information in photos, folders, advertisements, websites and/or other information carriers, insofar as these have been drawn up or published under the responsibility of third parties. GERMANS TRAVEL is also not responsible for the correctness or completeness of information that is distributed via the website and/or the social media channels of GERMANS TRAVEL.

ITEM 3. PAYMENT

1. When the travel agreement is concluded, the full amount of the total agreed travel sum must be paid. In exceptional cases (for example with a trip that is booked very long in advance), a different (down) payment arrangement can be agreed.

2. In the case of a (down) payment arrangement, the remainder of the travel sum must be paid no later than 2 months before the day of departure. Even if the travel agreement is concluded within 2 months before the day of departure, the entire travel sum must be paid immediately after the travel agreement has been concluded. This term is a strict deadline and in the event of late payment, the main booker is in default without notice of default being required. In that case, GERMANS TRAVEL is authorized to dissolve the travel agreement with immediate effect, whereby cancellation costs will be charged to the main booker.

3. Payments must be transferred to one of the bank accounts of GERMANS TRAVEL or be paid via a digital payment link where payment can be made by credit card.

ITEM 4. TRAVEL SUM

1. The travel sum is based on prices, exchange rates, levies and taxes, as they were known to GERMANS TRAVEL at the time of compiling the trip. The stated travel sums are per person, unless stated otherwise.

2. As long as the entire travel sum has not been paid, GERMANS TRAVEL has the right to increase the travel sum up to 10 days before the day of departure in connection with changes in transport costs, changes in tour costs, the taxes owed, levies and applicable exchange rates.

3. All accommodations, car/RV rental and activities mentioned in the program are available at the time of sending. Please note: the program has not yet been reserved for you. The actual booking will be completed when the money is received by GERMANS TRAVEL. If an accommodation, means of transport or activity is not available when booking, we will look for a suitable alternative in consultation with you.

ITEM 5. TRAVEL DOCUMENTS AND TRAVEL CONFIRMATIONS

1. The traveler must be in possession of the necessary valid documents on departure and during the trip, such as a passport and any required visas, proof of vaccinations and (international) driving license (with self-drive). The traveler must use the general information provided by GERMANS TRAVEL to check for correctness in this regard with authorities that can provide a definitive answer. If the aforementioned is not complied with by the traveler and the traveler is therefore unable to make the trip or not completely, the costs with all associated consequences will be carried exclusively by the traveler. 

In such a case, the traveler is not entitled to a refund of the travel sum. The main booker is solely responsible and liable for correct travel documents.

2. Prior to departure, the traveler must obtain information about the current health situation in the travel area from the competent authorities and take measures with regard to any necessary vaccinations. For current information about vaccinations, it is best to contact your own GP or the GGD in your region.

3. GERMANS TRAVEL makes the necessary travel documents available no later than 2 months before the departure of the traveler, provided full payment of the travel sum has been made. When full payment of the travel sum has been made, it can take up to 5 working days before the travel documents are available to the traveler. If full payment of the travel sum has not yet been made, the travel documents will not yet be sent to the traveler.

4. GERMANS TRAVEL uses two types of travel documents:

a. Vouchers booked on date: The trip is booked on fixed dates. The traveler must reconfirm all travel components (accommodation, activity/tour, transport) at least 48 hours in advance, or if otherwise indicated on the travel voucher, by telephone or email.

b. Vouchers with an open date: The travel components have been booked, but no date has yet been set. The traveler must validate the voucher(s) himself by booking them directly with the provider on the desired date. GERMANS TRAVEL recommends booking day trips by date at least 3-7 days in advance. For popular overnight trips (including Fraser Island & Whitsundays tours) 14-21 days in advance is recommended. Please note, during high season it is wise to book popular travel components 21 days or more in advance due to high season crowds. The planning of dates is the responsibility of the traveler and availability depends on the availability of the provider. It is not possible to book motorhome or car rental with an open date.

ITEM 6. CHANGES BY THE TRAVELER

1. The traveler can request changes to the trip up to 14 days before departure. These changes will be made to the extent reasonably possible. If a change results in a changed overall travel price, the traveler must pay the new price, after deduction of the amount already paid. In addition to the actual costs, GERMANS TRAVEL is entitled to charge a change fee of 10% for the changed part of the trip, or of the total travel price per booking and per change. Postponing or rescheduling of the departure dates is considered a change by the traveler. Reduction in the number of paying travelers is considered a (partial) cancellation to which ITEM 7 applies.

2. Before the start of the trip, the traveler can be replaced by another person, a so-called "name change", provided that the other person meets the conditions attached to the travel agreement, the provider agrees to this and the request is submitted no later than 30 days before departure. is becoming. The main booker, the traveler and the person who replaces them are jointly and severally liable towards GERMANS TRAVEL for the payment of the part of the travel sum still owed, the change costs referred to in ITEM 6 paragraph 1 and any additional costs as a result of the replacement.

ITEM 7. CANCELLATION BY THE TRAVELER

1. If a travel agreement is canceled by the traveler, the traveler owes the following cancellation costs:

a. In the event of cancellation: 20% of the total travel sum plus any non-refundable cancellation costs from the provider(s). This can mean that if the traveller cancels shortly before departure, the cancellation costs may equal up to 100% of the total travel sum.

b. In case of cancellation due to border restrictions or other Covid-19 related matters beyond the travellers control, it is possible to receive a voucher worth the sum of the canceled travel components. This travel voucher is valid for 1 year and can be used with all products offered by GERMANS TRAVEL. Whether the voucher can be offered depends on the terms and conditions of the providers/third party. If they do not offer a credit or refund the traveller can recover their costs with their travel insurance.

c. Credit card costs when paying by credit card will in no case be reimbursed

2. If the trip consists of different parts, to which different cancellation provisions apply, the provisions specifically applicable to each part will apply, which may entail an increase in the cancellation costs referred to in paragraph 1 (for example, a different policy applies to bus tickets). Cancellation scheme where the cancellation costs amount to 100%.

3. GERMANS TRAVEL has not taken out travel and cancellation insurance. A standard continuous cancellation insurance has covered up to a travel sum of a maximum of € 1500 per person. We recommend that you check this with your insurance company and we recommend that you always take out good travel and cancellation insurance before departure. In this we endorse the recommendation of the Ministry of Foreign Affairs and Trade. It is your personal responsibility to take out insurance that covers all liability for which you wish to be insured.

We recommend that you take out insurance that includes a cancellation insurance/clause. If your flight is delayed, or your bus is unable to depart/is very delayed which prevents you from doing your tour/activity, you can claim back the cost of the missed tour/activity from your insurance. Please note: most insurance policies only reimburse tours and activities that are booked before the departure abroad, not what has been booked or additionally booked during the trip.

ITEM 8. CANCELLATION BY GERMANS TRAVEL OR THIRD PARTIES/PROVIDERS

1. GERMANS TRAVEL has the right to cancel the travel agreement with immediate effect if there are circumstances that are of such a nature that further binding of GERMANS TRAVEL to the travel agreement cannot reasonably be required.

2. If the circumstances referred to in paragraph 1 can be attributed to the traveler, the resulting damage will be borne by the traveler. If the cause of the cancellation can be attributed to GERMANS TRAVEL, the resulting damage will be borne by GERMANS TRAVEL. If the cause of the cancellation cannot be attributed to either the traveler or GERMANS TRAVEL, the parties each bear their own damage.

3. If a travel agreement or part of the trip is canceled by GERMANS TRAVEL or a third party/provider, the following cancellation costs apply:

a. 10% of the total travel sum or of the canceled part of the trip plus any non-refundable cancellation costs from the provider(s).

This does not apply to the following activities: A diving course where the traveler does not pass the medical test; the Heli & hike at Franz Josef (NZ) when canceled within 3 days of departure due to bad weather; there are no cancellation fees for these activities.

b. If a travel agreement is canceled by GERMANS TRAVEL or a third party/provider due to border restrictions or other Covid-19 related matters beyond your control, it is possible to receive a voucher worth the sum of the canceled travel components. This travel voucher is valid for 1 year and can be used on all our products. Whether we can actually offer you this voucher depends on the terms and conditions of the providers/third party. If they do charge costs, you can recover these from your cancellation and travel insurance. If a voucher is not chosen, the cancellation costs mentioned in paragraph 3 a will apply.

ITEM 9. LIABILITY AND FORCE MAJEURE

1. GERMANS TRAVEL cannot be held liable for damage arising as a result of the following circumstances:

a. war, threat of war, state of siege, quarantine, riot, acts of sabotage or terrorism, demonstrations, strike, exclusion or closure of travel routes, crime, boycott actions, scarcity of goods, disruptions in means of communication, disruptions in the (international) payment system, changes in travel advice as issued by the German Ministry of Foreign Affairs, disruptions in means of transport, delays in public means of transport.

b. social disruption as a result of natural disasters and serious accidents.

c. errors of third parties as well as non-compliance by third parties with their obligations when these third parties are not employees of GERMANS TRAVEL or are not directly engaged by GERMANS TRAVEL in the execution of the travel agreement.

2. GERMANS TRAVEL's liability for damage covered by the usual travel and cancellation insurance is excluded. Nor is GERMANS TRAVEL liable for damages that are excluded under applicable written or unwritten International Law.

3. GERMANS TRAVEL is never liable for loss or damage to luggage and travel documents.

ITEM 10. COMPLAINTS

1. A shortcoming in the implementation of the travel agreement must be reported locally as soon as possible, but no later than 48 hours after discovery by the traveler, so that a solution can be sought. For this, the traveler must report to (in the following order): the service provider concerned, the tour guide or, if this person is not present or accessible, GERMANS TRAVEL. If the shortcoming is not resolved and affects the quality of the trip, it must be reported immediately to GERMANS TRAVEL.

2. If the complaint is not resolved on the spot to the satisfaction of the traveler, the traveler must report this in writing to GERMANS TRAVEL.

3. If the traveler does not comply with this complaint obligation, and the service provider or GERMANS TRAVEL is not given the opportunity to remedy the shortcoming, the possible right of the traveler to compensation may be limited or excluded.

4. If a complaint has not been satisfactorily resolved, it must be submitted in writing to GERMANS TRAVEL no later than one month after the end of the trip or after the original departure date if the trip has not taken place, with a copy of the written notification as referred to under ITEM 10(2) is added.

5. If the traveler does not submit the complaint in time, it will not be processed by GERMANS TRAVEL, unless the late submission is not due to the traveler. GERMANS TRAVEL will confirm receipt of the complaint as well as whether or not it will be handled in writing.
